General Will Drafting

Omega Wills will come to your home, listen to what you want and then, draft your will according to your instructions.

The process of making a Will should be relatively painless and as a guide, our process starts with a Free 1 Hour Consultation. During this consultation, we cover such topics as Intestacy, Guardianship, Inheritance Tax and Care Fees, whilst also answering any other questions you may have.

After the consultation, we will have put together a picture and will present you with your options and costs.

We will then take your instructions based on your choice of option and provide you with a draft copy of your Will for approval or amending. Once you are satisfied with the contents, we will arrange an appointment for the attestation (signing & witnessing) of the original document where, you will require two witnesses.

We will supervise the whole process, ensuring you have a valid Will at the end of the attestation.

Long Term Care Planning

An increase in the number of people requiring Long Term Care has meant that more and more homes are sold to meet the costs of such care.

Under the Community Care Act 1990, if your care fees are paid by the council, they have the legal right to seize, sell your home and use the proceeds to pay for any such costs.

Dependant on your circumstances, it may be possible to help protect at least half and possibly all of the family home, being seized by local councils to pay for care costs.

Certain conditions must first be met but once achieved, will allow more of your children’s inheritance to pass to them instead of the council.

Life Interest Trust

A Life Interest Trust can be drafted into a Will, allowing a gift to pass to an ultimate beneficiary but allowing someone else the benefit of that gift, whilst they are still alive.

For example Eowyn is given £100,000 by her dad Eomer but, she can only receive the gift “absolutely”, when her mum Arwen dies. In the meantime, Arwen can enjoy the benefit of the interest from the £100,000 but, must preserve the capital sum.

This type of trust can be of particular interest to those who for example, are in a second marriage and want to ensure that children from their first marriage, are not “done out” of their inheritance.

When drafting a Will that addresses Long Term Care planning, consideration should also be given as to whether or not, a Life Interest Trust should also be included as part of the Will.

There may be certain conditions that must first be met, prior to a Life Interest Trust being included in your Will.

Inheritance Tax Planning (IHT)

When you leave a gift (not applicable to spouses or civil partners) over the Nil Rate Band (NRB) allowance, you will have to pay 40% inheritance tax to the government on any amount above the allowance threshold.

We can advise you in general terms on any IHT issues you may or may not have that, will be dependent, on how your estate is comprised.

However, we recommend you seek the advice of an Independent Financial Adviser for individual advice, specific to your circumstances.

Business Wills

If you run your own business, you may be able to benefit from 100% Business Property Relief however, without careful planning, any such benefits may ultimately be subject to Inheritance Tax at 40%.

Careful Will drafting can help avoid this unnecessary payment to the chancellor

Lasting Power of Attorney (LPA)

Most people acknowledge that it is important to organise their affairs in the event of their death, which is why so many people make a Will however, who will make decisions for you, should you become mentally or physically incapable, to manage your own affairs?

In comparison to Wills, far fewer people make similar provisions to organise their affairs should they become unable to look after themselves during their lifetime - an ever increasing possibility given the advances in medical care.

Omega Wills Ltd can produce a Legal Document called a LASTING POWER OF ATTORNEY (LPA).

An LPA is a document that enables you to appoint a person or persons, to look after your affairs in the event of your mental or physical incapacity, which may be caused due to old age, illness or accident.

It is important that such arrangements are made when you have your mental faculties, as if you lose or start losing them, it may be too late to make an LPA.

 

Document Storage (DocuStor)
